NT minimum lot size: 450 m² and battle-axe lots proposed for Zone LR

A proposed NT Planning Scheme amendment would cut the Zone LR minimum lot size from 800 m² to 450 m² and allow battle-axe lots in limited cases.

The Northern Territory is considering a cut to the NT minimum lot size in Zone LR (Low Density Residential) from 800 m² to 450 m², and allowing battle-axe lots in limited circumstances. The changes are in proposed NT Planning Scheme 2020 amendment PA2026/0205, published for comment as "Infill development and subdivision across the Territory". It was on public exhibition from Friday 24 July to 11.59 pm Friday 21 August 2026.

For owners of larger suburban blocks in Darwin, Palmerston, Katherine, Tennant Creek and Alice Springs, the proposal would allow smaller lots than the scheme permits today, if approved. It is still a proposal: the NT Planning Commission listed a hearing for Thursday 1 October 2026, and no ministerial decision has been published.

What is changing

The exhibited explanatory document and the marked-up scheme text set out these proposed changes for Zone LR:

Control in Zone LR Current Proposed
Minimum lot size (existing areas) 800 m² 450 m² (excluding any battle-axe lot access strip)
Lot size variation Up to 5% (minimum 760 m² lot) Up to 10% (minimum 405 m² lot)
Minimum frontage, lots 450 m² to under 600 m² 13 metres 12 metres
Dwelling-group and dwelling-multiple Prohibited Development permit required, at up to one dwelling per 450 m²
Battle-axe lots Clause 6.2.1 requires that there are no battle-axe lots Allowed in limited circumstances

On battle-axe lots, clause 6.2.1 of the scheme currently requires that "there are no battle-axe lots". The proposed replacement reads: "Battle-axe lots are to be avoided unless located in Zone LR and: (a) the configuration is necessary due to site irregularity; or (b) the configuration enables the retention of an existing dwelling."

The amendment would also prohibit subdivision, and dwelling-group or dwelling-multiple development, on Zone LR land affected by the flooding (clause 3.6) and storm surge (clause 3.7) overlays. The proposed scheme text keeps the requirement that lots are connected to reticulated services.

The Commission's earlier consultation FAQs say there are "about 8,000 lots in Zone LR across the Territory that are larger than 900m² and not affected by flooding or storm surge."

When it applies

Nothing has changed yet. Here is where the proposal stands as at 2 October 2026:

  • Initiated: the Minister initiated the amendment under section 12 of the Planning Act 1999, after the Commission's November–December 2025 consultation and its report to the Minister.
  • Exhibited: 24 July to 21 August 2026. The Commission's hearing report says 66 public submissions were received, along with responses from service authorities and councils.
  • Hearing: the Planning Commission listed a hearing by videoconference for Thursday 1 October 2026.
  • Still to happen: the Commission reports to the Minister for Lands, Planning and Environment, who makes the final decision. Submitters are told when a decision is made.

The official list of NT Planning Scheme 2020 amendments does not include PA2026/0205. The most recent listed amendment (Amendment 183) was published on 22 September 2026. The final rules could differ from what was exhibited.

What it could mean for your block

If the amendment is approved as exhibited, the clearest group who could be affected is owners of larger Zone LR lots outside the flooding and storm surge overlays. The exhibited explanatory document says that "in most cases, an existing lot size of at least 900m² is required to meet these standards, although smaller lots may be considered in limited circumstances."

It also answers a common question directly: an 800 m² block in Zone LR could not be subdivided, because each new lot would need to be at least 450 m² (or 405 m² with a variation). Lot size alone is not the whole picture. A proposal would still need to meet the scheme's other requirements, including frontage, access, setbacks, open space, landscaping and the connection to reticulated services. The Department's indicative maps "do not account for site-specific factors such as vehicle access, infrastructure capacity, or lot configuration." Other overlays, such as Clause 3.12 in Katherine East, would continue to apply.

Battle-axe lots would not be a general option either. They would be limited to sites where the layout is irregular or where a battle-axe configuration keeps an existing house. Applications for these developments would need a development permit and would be available online for the community to see.

Frequently asked questions

Has the 450 m² minimum lot size in Zone LR become law?

No. As at 2 October 2026 it is a proposed amendment to the NT Planning Scheme 2020. The NT Planning Commission listed a hearing for 1 October 2026 and will report to the Minister for Lands, Planning and Environment, who decides whether to approve, change or refuse it.

Could I subdivide an 800 m² block in Zone LR under the proposal?

The exhibited explanatory document says no. Each new lot would need to be at least 450 m², or no less than 405 m² with a variation, which an 800 m² site cannot achieve. It notes that in most cases a lot of at least 900 m² is needed.

Would battle-axe lots be allowed everywhere in Zone LR?

No. The proposed wording says battle-axe lots are to be avoided unless in Zone LR and the configuration is necessary due to site irregularity, or it enables an existing dwelling to be kept. Land affected by the flooding or storm surge overlays could not be subdivided.
